Supreme Court quashes ex parte Foreigners Tribunal orders in Assam
The Supreme Court ruled that a person's citizenship cannot be determined without a fair, lawful and reasoned process, setting aside a batch of ex parte orders passed by Foreigners Tribunals in Assam and directing fresh adjudication of the cases. According to Bar & Bench, a Bench of Justices Vikram Nath and Sandeep Mehta held that while the State has a legitimate interest in identifying illegal immigrants, that objective cannot come at the cost of procedural fairness. The State has a legitimate and compelling interest in ensuring that persons who are not legally entitled to claim Indian citizenship do not secure such status by misuse of process, by false claims or by taking advantage of delays... At the same time, the determination of such status must be made through a process which is fair, lawful and reasoned, the Court observed. The judgment came in a batch of appeals filed by persons from Assam who had been declared foreigners by Foreigners Tribunals and the erstwhile Illegal Migrants (Determination) Tribunals. They had challenged Gauhati High Court judgments upholding those declarations, contending that the proceedings were conducted ex parte or had effectively become ex parte, depriving them of a meaningful opportunity to contest the cases. The Bench examined three categories of cases: those persons who never appeared despite notices being recorded as served; those where the Gauhati High Court itself assessed documents while affirming ex parte tribunal orders; and cases where the persons initially participated but later stopped appearing before the tribunals. Referring to Section 9 of the Foreigners Act, 1946, the Court clarified that although the burden of proving citizenship rests on the person concerned, tribunals cannot mechanically accept the State's allegations in the absence of the proceedee. Section 9 does not authorise a mechanical declaration. It does not permit the reference to be accepted as conclusive merely because it has been made. It also does not permit the Tribunal to treat absence of the proceedee as a substitute for examination of the material placed before it, the Bench said. As reported by Bar & Bench, the Court held that even when a person fails to appear, Foreigners Tribunals, being quasi-judicial bodies, must satisfy themselves that notice was duly served, the allegations were properly disclosed, the State had produced material supporting the reference and the conclusions were backed by reasons. The Bench said these safeguards flow not only from the statutory framework but also from Articles 14 and 21 of the Constitution, which protect any person, including individuals whose citizenship is under scrutiny. At the same time, the Court clarified that its ruling does not dilute the burden placed on the proceedee under Section 9 of the Foreigners Act or confer any advantage on those who ultimately fail to establish their citizenship. Setting aside the Gauhati High Court judgments and the corresponding tribunal opinions, the Supreme Court remitted the matters to the respective Foreigners Tribunals for fresh adjudication. It stressed that it had not examined the merits of the appellants' citizenship claims or the authenticity of the documents relied upon by them. The appellants have been directed to appear before the concerned tribunals within four weeks, after which they will be allowed to file written statements, documents and affidavits. The State has also been granted liberty to lead evidence in support of its case. The Court directed the tribunals to decide the references afresh, uninfluenced by their earlier opinions, preferably within six months. It also ordered that no coercive action be taken against the appellants on the basis of the quashed orders, provided they cooperate with the fresh proceedings.

Mumbai, July 14 (PTI) The rupee depreciated 48 paise to 96.16 against the US dollar in early trade on Tuesday as heightened geopolitical uncertainty put pressure on most Asian currencies, including the rupee. Forex traders said the rupee came under pressure due to a combination of factors crude oil prices climbed on renewed geopolitical tensions, while demand for the US dollar increased as investors moved toward safe-haven assets. Furthermore, over 1.5 lakh weavers have been onboarded onto the Government e-Marketplace (GeM), with the Weavers MUDRA Scheme providing collateral-free loans to nearly 3 lakh beneficiaries. By connecting our domestic manufacturers, artisans, and innovators directly with global markets, these comprehensive reforms have structurally prepared us for the massive global step-up we see on display this week. Narayanan where he referred to the situation in alarming language: Large-scale illegal migration from East Pakistan/Bangladesh over several decades has been altering the demographic complexion of this state.
